Regulations of gallery sales

These Regulations define the rules for making purchases on the website run by diamondscraftshop.com. In the field of services provided electronically, the Regulations are the regulations referred to in art. 8 of the Act of 18 July 2002 on the provision of electronic services (Journal of Laws of 2002, No. 144, item 1204, as amended).
General provisions
The owner of the diamondscraftshop.com online store is NFT ART limited liability company with its registered office in Warsaw, ul. Sienna 65, 00-800 Warsaw, Poland, NIP: 1251729561, hereinafter referred to as the Seller.
The seller is the owner of the Diamondscraft brand.
The place of business is the seat of the Seller.

To use the diamondscraftshop.com website, including placing orders via this website, you need a device equipped with a web browser with javascript and cookies enabled, supporting the HTML5 standard with web storage technology.

 

Definitions:

 

Client

– a natural person, a legal person or an organizational unit without legal personality and having the capacity to perform acts in law, which, on the terms set out in these Regulations, places Orders on the website.
 

Consumer

– A customer who is a natural person using the website for purposes not directly related to its business or professional activity.


Subject of the transaction

- interchangeably referred to as the "Object" - listed and described on the website, to which the Sales Agreement applies.


Sales agreement

– a contract for the sale of Objects within the meaning of the Civil Code, concluded between the Seller and the Customer, using the Seller's website.

 

Website or Seller

– website available at artinhouse.pl through which the Customer can place an Order.


Order

– Customer's declaration of intent clearly specifying the type and quantity of Goods, aiming directly at concluding a Sales Agreement.

Selling item

The objects in the sale conducted by the Website are works of art, in particular paintings, coming directly from their creators or from owners who are not creators.


The objects offered by the Website may bear traces of the passage of time and individual characteristics. The Seller undertakes to inform the Buyers about the individual characteristics of the objects and to deliver them without defects, excluding the defects indicated in the sale offer.


The items offered on the Website have been accepted for sale on the basis of a consignment agreement or have been purchased by the Seller and are its property.
The sale does not, under any circumstances, cover copyrights, in particular the right to reproduce or commercially use objects or their images.


The condition for the acceptance of objects on the Website is the declaration by the owners of the objects that these objects are original, they are their property and do not infringe anyone's copyright.
The website reserves the right to remove objects from the website in relation to which there is a reasonable suspicion that the statements made in accordance with point 15 above are not true. The website is not responsible for hidden physical defects of objects and their legal defects.


The photos of the objects offered for sale presented on the Website may, due to their individual nature, slightly differ from the original, in particular in terms of colors or the visibility of invoices.
The owner of all photographs placed on the Website is the Seller, unless otherwise stated. It is forbidden to use the content published on the website without the written consent of the Seller.

Orders and conclusion of a sales contract
The condition for placing an Order in the Online Store by the Customer is to read these Regulations and accept its provisions during the execution of the Order.
Browsing the website's offer and asking questions does not require registration on the website.
Making a transaction requires the Customer to register on the site 
All prices on the website are gross prices in Polish zlotys or in another currency. Prices shown do not include shipping costs.


Orders are accepted via the diamondscraftshop.com website, as well as at the email address: info@diamondscraft.io
The Customer of the Website may open a buyer's account, providing him with additional functionalities reserved only for registered users.
For this purpose, the Customer should provide the login and password necessary to access his account. The Customer's login is the e-mail address provided by him. The password is a string of characters set by the Customer. The Customer's password is not known to the service and the Customer is obliged to keep it secret and protect it against unauthorized access by third parties.
Orders can be placed 24 hours a day, 7 days a week throughout the year, except for technical breaks or Internet network failures, resulting in the lack of access to the website.
The customer is responsible for the correct completion of the order form and contact details, including the exact address to which the purchased items are to be sent, as well as the telephone number and e-mail address. If the Customer wants to place another Order and his contact details have changed, he is obliged to update them.
If the provided data is incorrect and causes damage to the Seller, the Seller has the right to charge the Customer with additional costs.


The customer receives a VAT invoice, which can be attached to the shipment or sent electronically to the indicated e-mail address. Most facilities are sold on a margin VAT system.
Placing an order is tantamount to expressing the Customer's consent to place his personal data in the website's database for processing in connection with the execution of the Order. Personal data will be protected in accordance with the Act of August 29, 1997. on the protection of personal data (i.e. Journal of Laws of 2002, No. 101, item 926, as amended) and the Privacy Policy.
After the Customer places an order, he/she will receive an automatic response from the service confirming receipt of the order.
Then, as soon as possible, but not later than within 48 hours (not counting public holidays) from the date of placing the order to the e-mail address provided by the Customer, the service will provide confirmation of the transfer of the order for execution.
Confirmation of the transfer of the Order for execution is tantamount to concluding a Sales Agreement.
The website reserves the right to withdraw from the order in the event of impossibility of its implementation.
If the deadline for confirming the order is extended, the service undertakes to immediately notify the Customer of this fact, who in this case has the right to withdraw from the order.
In the event of withdrawal from the order by either party in accordance with point 33 or 34 above, the service will return to the Customer all payments made by him.


payment

Payments for the price of work and transport costs are made when placing an order via paypal or payu.
Receipt of payment is a condition for delivery of works by the service
 

Delivery

Purchased items are sent within 72 hours of receiving the payment at the latest, except for Saturdays, Sundays and holidays, via a courier company.
The cost of delivery is covered by the customer. Fees may vary depending on the item offered and are stated in the order in the "Method of delivery" section.


In exceptional cases, the cost of shipping is calculated individually, at the Customer's request.
The delivery time of the purchased item from the moment of posting is on average:
in the case of a domestic courier company - on the next day
in the case of a foreign shipment, depending on the delivery address
The website is not responsible for the loss of objects or damage caused by courier companies.
The Buyer may also collect the purchased item in person, after prior arrangement of the circumstances of receipt with the Seller.
The customer who is a consumer has the right to return the object purchased on the website, without giving any reason, within 14 days from the date of its receipt. In this case, the service will return all payments received from the Customer.

The payment will be refunded immediately after the service receives the returned item, provided that the Customer returns the item in the same condition as in which it was purchased. The customer undertakes to properly secure the returned shipment. At the Customer's request, the Seller will provide all instructions as to the proper form of packing the returned item.
In the case of domestic returns, in the case of returning the purchased item, the service returns the cost of sending the item back to the Customer up to the amount of the shipping costs specified in the offer.

The customer may use the withdrawal form provided below:

The right to return does not apply if the purchased object has been adapted or processed at the customer's request, in particular framed or removed from the stretcher.


Complaints

The seller emphasizes that the subject of his offer are individual items, often used, and the linen is a soft item, easily scratched and micro-dented. Although the Seller makes every effort to accurately describe any defects in the offered items, the vast majority of them show traces of the passage of time.
The customer may submit complaints to the Seller regarding the purchased item at info@artinhouse.pl or in writing to the Seller's address. A properly submitted complaint should contain at least:
name, surname, address, e-mail address of the Customer,
date of purchase of the advertised item,
the subject of the complaint, indicating the Customer's request,
all circumstances justifying the complaint
If the data or information provided in the complaint need to be supplemented, before considering the complaint, the service asks the complainant to supplement it in the indicated scope.
The website recognizes the complaint within 14 days from the date of its receipt in the correct form.
The response to the complaint is sent to the e-mail address provided by the Customer or to the traditional mail address.

 

Personal data protection

The administrator of Customers' personal data provided to the website voluntarily as part of Registration and placing an Order is the Seller.

The website processes personal data necessary for the proper execution of the order, i.e. the Customer's name and surname, email address, postal address and contact telephone number. The website contacts the customer by phone and via email.
Each customer has the right to inspect their personal data and to correct them in the shared user profile, as well as the right to request the removal of data from the website's customer database, after prior notification in writing or electronic form
Customers' personal data are treated as confidential, are protected against access by unauthorized persons and are not disclosed to third parties. They may be transferred to entrepreneurs intermediating in ordering courier services, postal operators and courier companies only for the purpose of order fulfillment.


In special situations provided for by Polish law, personal data may be made available to state institutions and authorities.
Customers who have agreed to receive the Newsletter may remove their e-mail address from the mailing list by clicking on the unsubscribe form at the bottom of the Newsletter and in the settings tab on the user's profile.

Final Provisions

In matters not regulated by these Regulations, the provisions of the Civil Code shall apply.
The website reserves the right to make changes to the Regulations. Registered Customers will be informed about the change of the regulations during the next login on the website and / or by e-mail. If the changes to the Regulations are not accepted, the Customer Account will be deleted
The website respects the freedom of artistic expression guaranteed by art. 73 of the Constitution of the Republic of Poland. and is not responsible for the content expressed by the displayed Objects, in particular those prohibited by law, vulgar, offensive or otherwise violating the principles of social coexistence.
